Welcome to use Rush FM (hereinafter referred to as the "Application"). This Terms of Service (hereinafter referred to as the "Agreement") is a legal agreement concluded between you and the operating entity of the Application as well as its affiliated companies (hereinafter referred to as "we", "us" or "the Company") regarding your use of the Application.
Please carefully read all clauses of this Agreement before using Rush FM and its services. This Agreement and the Privacy Policy complement each other. By opening the Application and using the services, you shall be deemed to have accepted all provisions of this Agreement; if you do not agree, please do not use the Application.
1.1 Core Services
The services provided by this Application include but are not limited to audio dramas, cover images, synopsis content and relevant recommended materials; you may browse, select, play, pause, switch between and download content. In addition, we support account registration, account login, VIP subscription, Coins purchase/subscription, Coins/Bonus redemption and other services. Specific service contents and rules shall be subject to the actual display within the Application.
1.2 We reserve the right to optimize and adjust services (including adding or removing content, adjusting functions, etc.) in response to technical upgrades, content updates and regulatory compliance requirements without separate notice, provided such adjustments do not impair core usability.
1.3 Services are available only to users who have reached the legal age of majority in their respective country or region; minors shall use the Application in compliance with applicable local regulations.
2.1 You may complete registration or login via third-party accounts supported by the Application, such as Google Account, Apple ID and Facebook Account.
2.2 You shall properly keep your account password and relevant verification information. All losses arising from account theft or information leakage shall be borne solely by you. Promptly contact our support team if you detect abnormal account activity.
2.3 Malicious bulk account registration (including without limitation mass registration and registration using false information) is prohibited. We reserve the right to suspend relevant accounts and pursue corresponding liabilities upon violation.
2.4 You hold the right to delete your account. Once you select account deletion in Settings, all your data including purchase/subscription records, playback/view history, search logs and account credentials will be permanently erased, and all resulting losses shall be your sole responsibility.
3.1 Your use of the Application shall abide by applicable laws and regulations of your country or region of residence.
3.2 You shall not crack, tamper with or disrupt the normal operation of this Application, nor disclose its source code, audio drama content, payment system, Coins ecosystem or any related confidential technical information.
3.3 You are forbidden to copy, distribute, sell or adapt any audio drama content available within the Application, and shall not infringe upon intellectual property rights held by us or relevant copyright owners.
3.4 You shall secure your personal device and be fully accountable for all activities conducted on your device; any losses caused by your personal negligence shall be borne exclusively by you.
3.5 You shall not obtain Coins/Bonus or unlock drama episodes through any illegal or fraudulent means.
4.1 Partial audio drama content within the Application may contain materials unsuitable for minors. You must confirm you have attained the minimum legal age required by local jurisdiction, generally 13 years old; for users residing in the European Union / European Economic Area, the minimum applicable age is 16 years old or otherwise as stipulated by local mandatory laws.
4.2 If you are a minor below the legally required age, your usage of the Application must occur with explicit consent, supervision and guidance from your legal guardian (hereinafter referred to as "Guardian"). The Guardian shall bear full legal liability for all activities and consequences generated by the minor on this platform.
4.3 If a Guardian deems certain content or in-app payment functions inappropriate for a minor, the Guardian shall restrict or terminate the minor’s access to this Application.
5.1 VIP Subscription Service
1. You may purchase VIP membership via available in-app payment channels including Google Pay and Apple Pay. Specific benefits, pricing and subscription cycles (weekly, monthly, annual passes, etc.) are subject to real-time pricing displayed inside the Application.
2. We will continue providing entitled VIP services throughout your active subscription term, with relevant fees automatically deducted from your designated payment method as pre-authorised. Mid-term refunds are not permissible except where persistent unfixable service failures attributable to our system malfunction render VIP access unusable. Upon subscription expiry without timely renewal, all VIP privileges will expire automatically.
3. To modify your subscription plan, cancel auto-renewal via your original payment channel prior to your ongoing subscription expiry. Contact customer support for further enquiries. After auto-renewal cancellation, your purchased VIP benefits remain valid until the end of the current billing cycle.
4. We retain the right to revise VIP pricing and included benefits per operational needs. Updated pricing and benefits will be posted on the VIP subscription page and take effect immediately for new subscribers; existing subscribers retain their contracted pricing and benefits until their respective subscription period expires.
5.2 Coins/Bonus Service
1. Coins and Bonus are virtual in-app currencies exclusively redeemable to unlock designated audio drama episodes within the Application. They cannot be exchanged for cash, transferred to third-party users or spent outside the Application ecosystem.
2. Coins/Bonus Acquisition Methods:
- Paid Purchase/Subscription: Purchase standalone Coins or bundled Coins packages via supported in-app payment gateways such as Google Pay and Apple Pay; selected tiers come with complimentary Bonus as displayed in the Application. Coins/Bonus are credited instantly upon successful payment and are non-refundable except for cases where system error causes missing top-up, which may be resolved via customer service support.
3. Coins/Bonus Usage Rules:
- Episode Unlocking: Spend Coins or Bonus to access paywalled audio drama episodes at the quantity rate specified on each episode detail page.
- Bonus Expiry: All credited Bonus carries a validity period detailed within in-app guidelines; unused expired Bonus is forfeited permanently with no replacement or compensation provided.
- Anti-Cheating Regulation: Any illegitimate exploit or manipulation to gain Coins/Bonus is prohibited. Upon detection, we reserve rights to freeze existing Coins/Bonus balance, suspend the violating account and pursue legal liabilities.
5.3 Ad-Based Episode Unlock Service
1. Selected audio drama episodes can be unlocked for free by watching in-app advertisements under unlock rules shown inside the Application.
2. We may adjust the scope of ad-unlockable episodes and relevant rules for business needs without prior notice.
3. In cases where advertisements fail to load or your daily ad view limit is exhausted, you may unlock target episodes via alternative options including Coins/Bonus redemption or VIP subscription.
6.1 The Application displays third-party advertisements, for whose authenticity, legality and accuracy we assume no liability. You independently evaluate associated risks and bear all legal responsibilities arising from visiting external third-party websites or utilizing third-party services.
6.2 Certain ad providers may collect non-personal identifiers and user behavioral data from your terminal device via Cookies, SDK or comparable technologies to deliver personalized targeted ads. You may opt out of personalized ad tracking per your preference; refer to the respective third-party’s Privacy Policy for detailed data collection clauses.
7.1 We legally hold all intellectual property rights pertaining to this Application, including but not limited to source code, UI design, trademarks, logos, textual descriptions, payment architecture and proprietary technical developments. No unauthorized reproduction, distribution, modification, reverse engineering or commercial/non-commercial exploitation is permitted without our prior written approval.
7.2 Intellectual property rights for all in-app audio drama content (audio tracks, written scripts, artwork, background music, etc.) belong exclusively to us or respective authorized copyright holders.
7.3 Without formal written licensing, you are prohibited from:
- Copying, reposting, distributing or publicly displaying copyrighted content;
- Adaptation, translation or derivative creation based on original content;
- Any commercial use or monetization via copyrighted materials;
- Extracting or altering drama content for profit-driven commercial activities.
7.4 Any breach of this clause subjects you to full resulting legal liabilities including financial compensation to us and relevant copyright owners, and we reserve the right to terminate all ongoing Application services for the violating account immediately.
8.1 We accept no liability for service interruption caused by force majeure events including natural disasters, warfare, nationwide internet outages or changes in governing regulatory policies.
8.2 Service malfunctions stemming from your personal device faults or unstable internet connection (such as login failure, payment errors or ad playback issues) are your sole responsibility to troubleshoot. We will reasonably repair breakdowns confirmed to originate from our core Application system defects.
8.3 We provide no express or implied warranty regarding uninterrupted service stability, complete content availability or consistent ad playback. We shall not compensate for damages incurred from non-wilful or non-gross-negligence operational shortcomings.
8.4 We do not guarantee future episode updates, permanent content hosting on the platform, immutable VIP privileges, fixed ad-unlock policies or static in-app pricing, and bear no supplementary compensation obligations for related modifications.
8.5 We assist users in liaising with relevant third-party vendors for issues arising outside our direct control (such as failed payments, missing Coins/Bonus or unavailable ad unlock caused by faults of Google Pay, Apple Pay or external ad partners), yet accept no direct liability for such third-party-originated disputes.
9.1 This Agreement becomes effective upon your first use of the Application and remains valid until the Application ceases official operation or you permanently discontinue all service usage.
9.2 We reserve the right to immediately terminate your access without prior notice and financial reimbursement if you violate any agreed terms; you shall compensate all damages incurred to our business, and unused remaining VIP tenure and valid Coins/Bonus balances are non-refundable upon account suspension.
9.3 If the Application discontinues operation or you voluntarily complete account deletion, all unused remaining VIP duration and outstanding valid Coins/Bonus automatically expire without cash refund, and we are released from all obligations to preserve your purchase records, playback logs, downloaded files and archived account data.
10.1 We may revise these Terms per updated legislation or operational requirements. Revised terms take effect immediately upon public posting with updated effective date marked at the top of this document.
10.2 Continued use of the Application following policy updates constitutes your full acceptance of revised clauses; cease usage immediately if you disagree with amended provisions.
11.1 This Agreement shall be governed by the laws of your competent jurisdiction (excluding conflict of law rules). Mandatory local statutory provisions shall supersede conflicting clauses herein where applicable.
11.2 All disputes shall first undergo amicable negotiation. Failing settlement via negotiation, either party may file litigation with the competent people’s court located at our operating entity’s registered domicile.
We highly prioritize and rigorously safeguard your personal privacy and information security.
To sustain normal Application operation, enhance user experience, administer account functions, process payment transactions and comply with statutory legal requirements, we lawfully collect, store, utilize, transmit and appropriately disclose your personal information strictly in accordance with our published Privacy Policy, while implementing comprehensive security protocols to prevent data leakage, abuse and unlawful exploitation.
